Terms of Service

These Terms are the agreement between you and UP. They cover who can use the app, what you can post, and what happens when someone breaks the rules.

Acceptance of These Terms

UP is operated by UP Experiences, Inc., a Delaware corporation headquartered in Charleston, South Carolina (“UP”, “we”, “us”). By creating an account, or by otherwise using the UP app, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use UP.

These Terms are between you and UP Experiences, Inc. Apple is not a party to them and is not responsible for UP or its content.

Who Can Use UP

You must be at least 13 years old to use UP.

• You must give us an accurate date of birth. Entering a false date of birth is a violation of these Terms and is grounds for removing your account.
• Venues we have flagged as 18 and over are hidden from accounts under 18.
• UP shows bars, nightlife, and drink specials. UP does not sell, serve, or deliver alcohol. You must meet the legal drinking age where you are (21 in the United States) before you buy or consume alcohol, and each venue enforces its own age and entry rules.
• You may not use UP if we have previously removed your account.

Your Account

You are responsible for everything that happens under your account.

• Keep your password private and do not let anyone else use your account.
• Keep your profile information accurate, including your city and date of birth.
• Do not impersonate another person, business, or venue, or claim a business listing you are not authorised to represent.
• Tell us right away at the email below if you believe someone else has accessed your account.

You may delete your account at any time from your profile settings, or by emailing us.

Your Content

UP lets you post content — Drops (photo posts), profile and artist photos, Plans, usernames, reviews, messages, and business listing details. You own what you post.

By posting, you grant UP a worldwide, non-exclusive, royalty-free licence to host, store, resize, display, and distribute that content inside the app and in features that surface it (for example the Discover feed, a venue page, or a shared link). This licence exists so we can operate UP, and it ends when you delete the content, except for copies already shared by other users and backups we retire on our normal schedule.

You confirm that you have the right to post what you post, that you have permission from anyone identifiable in a photo, and that your content does not infringe anyone else’s rights.

Content Standards & Zero Tolerance

You may not post, send, or share:

• Harassment, bullying, threats, stalking, or hate speech targeting any person or group
• Sexually explicit or pornographic material, or any sexual content involving minors
• Violent, graphic, or gratuitously disturbing material
• Content promoting illegal drugs, underage drinking, weapons sales, or other illegal activity
• Spam, scams, phishing, or repetitive promotional posting
• Someone else’s private information, or content that impersonates another person or business
• Anything that infringes copyright, trademark, or other rights

How we enforce this:

• You can report objectionable content or an abusive user from inside the app using the report control, or by emailing us at the address below. Emailed reports are treated exactly the same way.
• You can block a user from your Friends list, which stops them from sending you requests or finding you in search.
• We review every report within 24 hours.
• We may remove content, restrict features, or terminate an account at our sole discretion, with or without notice, when we believe these standards have been broken.
• Uploaded photos are also screened automatically before they are published.

If you see something that breaks these standards, report it in the app or email us at the address below.

Venue Information

UP aggregates information about venues from public sources, from the businesses themselves, and from our users. Hours, prices, happy hours, specials, events, menus, and age policies change constantly and may be out of date or wrong.

Always confirm with the venue before you go, and treat everything in UP as a starting point rather than a guarantee. UP is not responsible for a venue’s pricing, service, admission decisions, or conduct.

Please drink responsibly, never drink and drive, and follow the law where you are.

Stays

Stays lets you send a booking request to a host. A request is an enquiry, not a confirmed reservation — the host chooses whether to accept it, and the stay is provided entirely by the host, not by UP.

UP charges no service fees and processes no payments. Any payment, deposit, cancellation, or refund is arranged directly between you and the host, and is governed by their terms. UP is not a party to that arrangement and is not a travel agency, broker, or insurer.

LEEBOT (AI Assistant)

LEEBOT is an AI assistant that helps you search for venues and plan a night out. Its answers are generated automatically and can be incomplete, out of date, or simply wrong.

Do not rely on LEEBOT for anything that matters — verify hours, prices, addresses, and age policies with the venue. LEEBOT does not give legal, medical, financial, or safety advice. You are responsible for the decisions you make based on its suggestions.

LEEBOT is powered by Claude, an AI model from Anthropic. Using it means your questions and some account context are sent to Anthropic to generate answers; the Privacy Policy lists exactly what, and UP asks for your agreement before your first message.

Acceptable Use of the Service

You agree not to:

• Scrape, crawl, or bulk-download UP data, or use automated tools against the service
• Reverse engineer, interfere with, or attempt to gain unauthorised access to UP or its systems
• Create accounts in bulk, or manipulate saves, votes, rankings, or reviews
• Use UP to advertise a competing service, or to send unsolicited messages to other users
• Use UP for anything illegal, or in a way that harms other users

Termination

You may stop using UP and delete your account at any time.

We may suspend or terminate your account, or remove your content, at our sole discretion — including immediately and without notice — if you break these Terms, if we believe you pose a risk to other users, or if we are required to by law. Terminated accounts lose access to content stored in the app. Sections that by their nature should survive termination — content licence for already-shared material, disclaimers, and limitation of liability — continue to apply.

Disclaimers & Limitation of Liability

UP is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not guarantee that the app will be uninterrupted, error-free, or accurate.

To the fullest extent permitted by law, UP Experiences, Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of UP, from content posted by other users, or from your dealings with any venue or host. Our total liability for any claim relating to UP will not exceed one hundred US dollars ($100).

Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via in-app notification or email. Continued use of UP after changes take effect constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of South Carolina, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or from your use of UP will be brought in the state or federal courts located in Charleston County, South Carolina, and you consent to their jurisdiction.
